Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the StatGallery iOS application, website at statgallery.com, and related services (collectively, the "Services") provided by StatGallery ("StatGallery," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility and Accounts
You must be able to form a binding contract to use the Services. By creating an account, you represent that the information you provide is accurate and that you will keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@statgallery.com if you believe your account has been compromised.
We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Services or other users.
User Responsibilities
You are responsible for your use of the Services and for any content, data, or information you submit, upload, or manage through your account.
If you manage teams, rosters, or player information on behalf of others, you represent that you have the authority to enter and manage that information and to grant other users access as appropriate.
If you submit or manage information relating to a minor, you represent that you have the authority to do so.
You agree to use the Services in compliance with applicable laws and these Terms.
Team and Player Data
StatGallery allows users to create, manage, and share team, player, game, and related sports information. Team and player information is generally available to users who have access to the associated team, such as coaches, staff, parents, guardians, and other authorized members.
StatGallery may also offer team discovery or search features that make limited team information visible to users searching for teams. Visibility and access may vary based on team settings, membership, and product features.
You are responsible for the accuracy of information you enter and for managing access to your teams appropriately. You are also responsible for obtaining any permissions, consents, or authorizations necessary to enter, manage, or share team and player information through the Services. StatGallery does not guarantee that any particular information will remain private from all other users if you grant team access or use discovery-related features.
User Generated Content
The Services may allow you and other authorized users to upload or submit photos, videos, clips, highlights, statistics, and other content ("User Content").
You retain ownership of your User Content, subject to the rights you grant below. You represent that you have the rights necessary to submit User Content and that your User Content does not violate the rights of others or applicable law.
You grant StatGallery a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your User Content solely as needed to operate, provide, and improve the Services.
We may remove User Content that violates these Terms or that we reasonably believe creates risk for StatGallery or other users.
Acceptable Use
You agree not to misuse the Services. For example, you may not:
Prohibited Conduct
Use the Services for unlawful, harmful, fraudulent, or abusive purposes.
Attempt to gain unauthorized access to accounts, systems, or data.
Interfere with or disrupt the integrity or performance of the Services.
Upload malware or content that infringes intellectual property or privacy rights.
Harass, threaten, or impersonate others.
Scrape, reverse engineer, or attempt to extract source code or underlying systems except as permitted by law.
Intellectual Property
The Services, including software, design, branding, logos, and other materials provided by StatGallery, are owned by StatGallery or its licensors and are protected by intellectual property laws.
Except for the limited rights expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.
Subscriptions and Billing
StatGallery may offer paid subscription plans, including StatGallery Pro, that unlock additional features. Subscription features, availability, and pricing may change over time.
Purchases of StatGallery Pro subscriptions are processed through Apple via the App Store. Apple is the merchant of record for App Store purchases, and your purchase is also subject to Apple's terms and policies.
We may use RevenueCat and related systems to manage subscription status and entitlements within the Services.
App Store Subscription Disclosures
StatGallery Pro is an auto-renewing subscription.
Monthly and annual subscription plans may be available. The specific plans offered may vary by platform, region, and release.
Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate and term shown in the App Store at the time of renewal.
You can manage or cancel subscriptions at any time through your Apple ID subscription settings after purchase.
Pricing may vary by region and is displayed in the App Store before you complete a purchase.
If a free trial is offered, any unused portion of a free trial period, if applicable, may be forfeited when you purchase a subscription, where allowed by applicable App Store rules.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
StatGallery does not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any information, statistics, or content will be accurate or complete.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATGALLERY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATGALLERY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO STATGALLERY FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or if we discontinue the Services.
Upon termination, your right to use the Services will end. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and dispute-related terms.
Changes to Services and Terms
We may modify, suspend, or discontinue any part of the Services at any time. We reserve the right to add, modify, remove, or discontinue features, functionality, subscription offerings, or pricing at any time. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page.
If we make material changes, we may provide additional notice through the Services or by other reasonable means. Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
Governing Law
These Terms and any disputes arising out of or relating to the Services or these Terms are governed by the laws of the State of California, without regard to conflict of law principles.
